- Trial court dismissed action based on failure to personally serve defendant. Plaintiff appealed stating service by publication was valid and trial court failed to analyze whether facts of case warranted personal jurisdiction via published service. Appeals court reversed long line of cases which incorrectly held published service could never confer personal jurisdiction.
